"You"meansanindividualorentityexercisingrightsunderthisLicensewhohas notpreviouslyviolatedthetermsofthisLicensewithrespecttotheWork,orwhohas receivedexpresspermissionfromtheLicensortoexerciserightsunderthisLicense despiteapreviousviolation. h. "PubliclyPerform"meanstoperformpublicrecitationsoftheWorkandto communicatetothepublicthosepublicrecitations,byanymeansorprocess,includingby wireorwirelessmeansorpublicdigitalperformances;tomakeavailabletothepublic WorksinsuchawaythatmembersofthepublicmayaccesstheseWorksfromaplaceandat aplaceindividuallychosenbythem;toperformtheWorktothepublicbyanymeansor processandthecommunicationtothepublicoftheperformancesoftheWork,includingby publicdigitalperformance;tobroadcastandrebroadcasttheWorkbyanymeansincluding signs,soundsorimages. i. "Reproduce"meanstomakecopiesoftheWorkbyanymeansincludingwithout limitationbysoundorvisualrecordingsandtherightoffixationandreproducing fixationsoftheWork,includingstorageofaprotectedperformanceorphonogramin digitalformorotherelectronicmedium. 2. FairDealingRights.NothinginthisLicenseisintendedtoreduce,limit,orrestrictanyuses freefromcopyrightorrightsarisingfromlimitationsorexceptionsthatareprovidedforin connectionwiththecopyrightprotectionundercopyrightlaworotherapplicablelaws. 3. LimitationonLiability.EXCEPTTOTHEEXTENTREQUIREDBYAPPLICABLELAW,INNOEVENTWILL LICENSORBELIABLETOYOUONANYLEGALTHEORYFORANYSPECIAL,INCIDENTAL,CONSEQUENTIAL, PUNITIVEOREXEMPLARYDAMAGESARISINGOUTOFTHISLICENSEORTHEUSEOFTHEWORK,EVENIF LICENSORHASBEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES. 7. Termination a. ThisLicenseandtherightsgrantedhereunderwillterminateautomaticallyuponanybreachby YouofthetermsofthisLicense.IndividualsorentitieswhohavereceivedCollections fromYouunderthisLicense,however,willnothavetheirlicensesterminatedprovided suchindividualsorentitiesremaininfullcompliancewiththoselicenses.Sections1,2, 5,6,7,and8willsurviveanyterminationofthisLicense. b. IfanyprovisionofthisLicenseisinvalidorunenforceableunderapplicablelaw,itshall notaffectthevalidityorenforceabilityoftheremainderofthetermsofthisLicense, andwithoutfurtheractionbythepartiestothisagreement,suchprovisionshallbe reformedtotheminimumextentnecessarytomakesuchprovisionvalidandenforceable. c.
