本課程所教授之範圍包括：法例、權利主體、權利客體、法律行為、期間與期日、消滅時效、權利之行使等。

本課程之教學目標，除引導學生正確認識上述法律關係，訓練其處理相關法律爭端之思惟能力外，亦在啟發其對法治社會之使命感。

CIVILLAW:GENERALPRINCIPLES SpecialLL.M.first-year required(6–0) Thecourseisdesigned tohelpstudentsunderstandthebasicprinciplesprovidedin“General Provisions”PartoftheROCCivilCode(art.1-152),discoverthesignificance ofcivillaw,andobservethedifferenttypesandcontentsofcivil relationshipswiththeirtransformations.Thetopicsincludedinthis courseare:applicationandinterpretationoflaws,persons,things, juridicalacts,datesandperiods,statuteoflimitations,andexercise ofrights.Inadditionstocorrectapplicationofsuchrulesinspecific cases,itisalsoanticipatedthatthestudentsbeequippedwiththe capabilitytoresolverelatedlegaldisputesandbeinspiredtocommit tosocietywithruleoflaw. 　 刑法總則　 法碩專一必　（3—3） 國內大學法律系之刑法科目，分為一年級之「刑法總則」與二年級之「刑法分則」，事實上「刑法總則」與「刑法分則」乃我國刑法典上之用語，然刑法學雖以刑法典為基本內容，但並不以此為限。

刑法學係以刑法為研究對象之學問，而刑法係規定犯罪與刑罰之法律。

至於「刑法總論」則係以刑法中「刑法總則」（第一條至第九十九條）為主要對象，亦即研究一般概念之犯罪（第一條至第三十一條）與刑罰（第三十二條至第九十九條）； 換言之「刑法總論」係以「何謂犯罪」、「犯罪須具備那些要件、要素」、「其理由（根據）為何」等為主要內容。

因此如何使一年級學生有體系性地思考、理解這些內容，乃本學科教學上最重要之任務。

GENERALPRINCIPLESOF CRIMAINALCODE SpecialLL.M.first-year required(3–3) Indomesticlawschools, "GeneralPrinciplesofCriminalCode"isforthefirst-year studentstostudyand"CriminalCode-SpecificOffenses"for thesecond-yearstudents.Asamatteroffact,theterms"General PrinciplesofCriminalCode"and"CriminalCode-SpecificOffenses" areterminologyusedintheCriminalCodeoftheR.O.C.Thecontent ofcriminallawshouldhavecoveragebroaderthantheCriminalCode itself,thoughtheCriminalCodeisthebasicpartofthecriminallaw. Criminologyistostudy theCriminalCode,andtheCriminalCodeisthelawprescribingcrimes andpenalties.Asaresult,GeneralconceptsofCriminalLawshallcover, inprinciple,theGeneralPrinciplesofCriminalCode(Article1-99). Inotherwords,thiscourseistostudythegeneralconceptsregarding crimes(Articles1-31)andpenalties(Articles32-99). Inotherwords,General conceptsofCriminalLawwillfocusonthetopicssuchaswhatisa crime,elementsofacrime,rationale(basis)forprescribingacrime. Accordingly,themainobjectiveofthiscourseistotrainthefirst-year studentstothinksystematicallyandtoapprehendrelevantissues. 憲法 法碩專一必 （2—2） 憲法課程主要包含：1.憲法之理論基礎及國家構成要素；2.人民之基本權利及義務；3.國家之體制及權力分配、中央及地方政府之組織；4.基本國策等四大部分，此外，在附則部分並論及憲法之解釋及修正，與過渡規定。

CONSTITUTIONALLAWOF R.O.C. SpecialLL.M.first-year required(2–2) Thecoursemainlyconsists offourparts:(1)thetheoreticalbasisofaConstitutionandtheformative elementsofaState;(2)fundamentalcivilrightsandduties;(3)national institutionsandseparationofpowers,togetherwithorganizationsof centralandlocalgovernments;(4)basicnationalpolicies.Inadditional parts,interpretations,revisionsandtransitionalprovisionsofConstitution arealsodiscussed. 　 國際公法 法碩專一必 （2—2） 本課程以提供國際公法之基本概念為目的，主題涵蓋國際公法的法源、主體、承認、主權、管轄權、國家義務、繼承、外交關係、條約法、武力的使用與國際爭端之司法解決及仲裁。

　 PUBLICINTERNATIONALLAW SpecialLL.M.first-year required(2–2) Thiscourseisintended toprovideafoundationinthebasicelementsofpublicinternational law.Itcoverssuchtopicsasthesourcesofinternationallaw,legal entity,recognition,territorialsovereignty,jurisdiction,stateresponsibility, succession,diplomaticrelations,thelawoftreaty,theuseofforce andthesettlementofdisputesbyjudicialsettlementandarbitration. 　 英美法概論 法碩專一　必 （2—2） 希藉英美法院案例解析與相關資料研讀之指導，初步培養學生接觸、試讀英美法律資料之能力，並以法院判決書之研讀，指導學生如何解讀：法院裁判、當事人訴訟上之主張、爭點之形成、法律之適用與解釋，並學習案例之寫作，另以課堂討論與講解並用方式簡介：英美法律體系、法源、司法制度、法律倫理、法律教育及法律人之社會責任等，作為學生學習英美法之入門課程，奠定其法學上之思考、分析與判斷能力之基礎。

INTRODUCTIONTOANGLO-AMARICAN LAWSTUDIES SpecialLL.M.first-year required(2–2) Thiscourseisspecifically designedtobetakenbythefirstyearlawstudentsforaninitialunderstanding oftheAnglo-AmericanlawandanoverviewoftheAnglo-Americanlegal system.Thecourseconcentratesnotonlyonprovidingleadingcases andvariouslegalmaterials,butonthemethodologyofhandlingthe casesstudythatespeciallywillsharpenthestudent'scapacityfor analyticalthoughtandhelpstudent"thinklikealawyer". Theverypurposeofthecourseistoenhancethestudenttousethe courseasastartingpointorasanessentialfoundationtostepinto thefurtherstudyoftheadvancedAnglo-Americanlawcourses,suchas Torts,Contracts,CriminallawandConstitutionallaw. 　 民法親屬 法碩專一必 （2—0） 本課程就（一）親屬範圍、親等及親屬關係之發生與消滅；（二）結婚及其效力；（三）離婚及其效力；（四）父母子女關係之發生、消滅及其權利義務；（五）監護；（六）扶養等部分，就新、舊法內容、學說及實務見解加以介紹說明，並提出未來修法之方向，期使理論與實務並重。

CIVILLAW:DOMESTICRELATION SpecialLL.M.first-year required(2-0) Thiscoursecovers1.the definitionofrelatives,degreeofkinsmenrelationship,establishment andextinctionofkinsmenrelationship,2.marriageanditseffect, 3.divorceanditseffect,4.establishmentandextinctionof,aswell asrightsandobligationsin,theparent-childrenrelationship,5.guardianship, 6.maintenanceobligations.Studentsaretostudythelawbycomparing thenewruleswiththeoldrules,legaltheoriesandcourtprecedents, andreviewthetrendsoflegaldevelopment.. 　 商事法總論及公司法 法碩專一必 （0—3） 本科目先講授商事法之概念、特性及其與公司法及商業登記法之相互關係。

次就公司法之總則中介紹有關公司之概念、組織、登記、名稱、機關、能力、解散部分，再就無限公司、有限公司、兩合公司之概念、特性、設立、法律關係、機關、會計、股東之變動、增減資、變更組織、解散與清算等比較三者之異同，且股份有限公司之公司債、公司重整之特殊問題也將一併說明。

授課方式除重法理之探討外，並舉實例以為闡明，其間更援引歐陸之學說、立法例及判例，進而比較我國現行之立法，探討修法理由，並研討經濟部有關法規之解釋，並就兩岸之公司法作有系統的比較、分析。

GENERALPRINCIPLESOF COMMERCIALLAWANDCOMPANYLAW SpecialLL.M.first-year required(0–3) Thecourselooksinto thebasicconcept,andthecharacteristicsofcommerciallawinTaiwan anditsrelationshipwithCompanyLawandBusinessRegistrationsAct. Then,themajorprovisionsofCompanyLawwillbeanalyzed,including thetypesofcompany,thepromotionandformationofcompany,thepersonnel andfinancialstructureofcompany,theshareandshareholdermeeting, thePresidentandtheboard,affiliatedcompanies,thedissolutionof companyandetc.Theteachingwilloccasionallyrefertosomeforeign legislation,includingPRC’scompanylaw,foracomparativestudy.Besides, therelatedcourtdecisions,judicialoradministrativeinterpretations aswellastheacademictheorieswillalsobecitedforstudents’references. 　 民法繼承 法碩專一必 （0—2） 繼承法為身分法之一種，然有關財產法之基本法律規範，仍多適用 。

本課程就（一）遺產繼承人之順序、應繼分；（二）繼承權之喪失；（三）繼承回復請求權；（四）遺產之標的；（五）共同繼承；（六）限定繼承、拋棄繼承及強制無限繼承；（七）無人承認繼承；（八）遺囑；（九）特留分等部分，就新、舊法內容、學說及實務見解以加以介紹說明，並提出未來修法之方向，期使理論與實務並重。

CIVILLAW:SUCCESSION SpecialLL.M.first-year required(0–2) Scholarstakelawofsuccession asabranchofpersonallegalaffairs,whilepartofthelegalprinciples governingpropertiesarebasicallyapplicabletotheformer.Thecourse includes:1.theorderofsuccessionandlegalsharesofheirs,2.forfeits ofrighttoinherit,3.restitutionclaimsasanheir,4.estateproperty, 5.co-inheritance,6.limitedsuccessionwaivedforinheritance,and mandatoryunlimitedsuccession,7.unacknowledgedsuccession,8.wills, 9.compulsorilyreservedshares.Thestudentsaretolearnbycomparing thenewruleswiththeoldrules,thetheoriesbehind,judicialprecedents, futuretrendsforlawdevelopment. 　 票據法 法碩專一必 （0—2） 本課程內容涵蓋票據（匯票、本票及支票）之分類及其使用、票據之簽名、票據代理（含票據無權代理）、執票人之權利及票據之移轉與背書等等。

於授課時亦著重票據法與民法和其他商事法之互動關係。

LAWOFBILLSANDNOTES SpecialLL.M.first-year required(0–2) Thiscourseincludes theclassificationanduseofnegotiableinstrument：Draft,Promissory noteandCheck；LiabilityofParties;Signature,SignaturebyAuthorized（Unauthorized）Agent; RightofaHolder(esp.,holderinduecourse);TransferandNegotiation byEndorsement,etc.ItalsocoversinterrelationswithCivilLawand otherCommercialLaw. 　 法律倫理學 法碩專一必（0—1） 希藉本課程之講授使法律系學生了解法律倫理學之意義與內涵、法律倫理學於法律人之重要性，及養成教育中法律人如何涵泳法律倫理；本課程之內容包括：緒論、法律倫理學之中心理念、法律倫理之基本信念與具體實踐。

LEGALETHICS SpecialLL.M.first-year required(0-1) Theaimofthiscourse istoacquaintlawstudentswiththemeaningandcontentsofLegalEthics, andtheethicalstandardsofthelegalprofession.Thecontentsofthis courseinclude:majorconceptsoflegalethics,essentialprinciples ofprofessionalethics,ethicalproblemsthatlawyersface,theadherence toandtheenforcementofEthicalRulesofLawyer’sConduct,andother issuesoftheprofessionalresponsibilityoflawyers.
