Finland[edit] AsuspendedsentenceiscalledehdollinenvankeusrangaistusinFinnish,whichtranslatesto"conditionalimprisonment".[2]Whenasentenceofimprisonment,whichcanbeatmosttwoyears,isimposedconditionally,theenforcementofthesentenceispostponedforaprobationperiod.Thelengthoftheprobationperiodisatleastoneandatmostthreeyears.Theprobationperiodbeginsatthepronouncementortheissueofthejudgment.Whenconditionalimprisonmentisimposed,theconvictedpersonshallbenotified,inconnectionwiththepronouncementortheissueofthejudgment,ofthedatewhentheprobationperiodendsandofthegroundsonwhichthesentencemaybeorderedtobeenforced.Asentenceofconditionalimprisonmentmaybecombinedwithfinesor,ifthesentenceislongerthaneightmonths,withcommunityserviceofatleast14andupto120hours.[3]Additionalsurveillanceoftheconvictedcanalsobeordered,ifitisseenasnecessarytoreducerecurrentcriminalbehaviour.[4][5] Thecourtmayordertheenforcementofconditionalimprisonmentiftheconvictedpersoncommitsanoffenceduringtheprobationperiodandthechargehasbeenbroughtwithinoneyearoftheendoftheprobationperiod.Inthisevent,theconditionalsentencetobeenforced,thesentencefortheoffencecommittedduringtheprobationperiodandthesentencesofimprisonmentfortheotheroffencesconsideredinthesametrialshallbejoinedasoneunconditionalsentenceofimprisonment.Thecourtmayalsoorderthatconditionalimprisonmentbeenforcedonlyinpart,inwhichcasetheremainderofthesentenceshallcontinuetobeconditional,subjecttothesameprobationperiod. Ireland[edit] InthelawoftheRepublicofIreland,the2006lawbywhichasuspendedsentenceisactivatedwasruledunconstitutionalin2016.The2006lawrequiredthatacourtdecisiononwhethertoactivatethesuspendedsentencebemadeassoonasalaterconvictionwashandeddown,eveniftherewasanappealpendingforthelaterconviction.[6][7][8]Subsequentlegislationintroducedin2017correctedthedeficienciesidentified,introducinganeffectiveappealmechanism.[9] Japan[edit] Suspendedsentences(執行猶予,shikkōyūyo)arecommonpracticeinJapanandcanbeappliedincaseswhereasentenceisforupto3yearsinprisonand/or500,000yeninfines.Anycriminalactivityduringtheperiodofthesuspendedsentencewillresultinthecancellationofthesentenceandimprisonmentfortheprescribedterm.[10] Russia[edit] InRussiasuspendedsentence(Russian:условныйсрок,lit. 'conditionalsentenceorprobation')iscommonplaceanditsapplicationisstipulatedbyanArticle73oftheRussianCriminalCode.[11][12]Thesuspendedsentencesmaynotbeappliedtochildoffenders(minorsaged14orlesswhentheoffencewascommitted),tothosewhohavecommittedaseriousorveryseriouscrime(thedefinitionofwhichisgivenbyArticle15ofthesameCodeasof2019),orincaseofcrimerecurrence.[11]Thejudgemayalsoimposeadditionalrestrictionsonhowtheprobationmustbeserved.Initialsentenceisenforcedincaseofconvictedfailingtofulfillconditionsoftheprobation.
