Dispatchedworkershaveoftenbeenderogatedas“disposablechopsticks”or“PETbottles”andsometimesevenconsideredoneofthemaincausesoflowwagesinthecountry.However,itisafactthatmanyenterprisesusethemtoreducepersonnelcosts.Forthisreason,theMOLbegantostudythefeasibilityofestablishingasetofregulationstoprotecttheinterestsofdispatchedworkerswhileatthesametimeensurethatenterpriseswouldpayhigherpersonnelcostsfordispatchedlaborthanhiringtheirownemployeeswhentheymakeuseofsuchflexiblehumanresources.Theobjectiveswereto“suppressquantitieswithpriceraises”tocutdownonuseofdispatchedworkersinthelabormarketandimprovethephenomenonofdispatchedworkersbeingregarded“cheaplabor.” Themainconcernsaboutdispatchedemploymenthavebeenwhetherdispatchworkersarebeingexploitedwithlowwagesorgivendiscriminatorytreatment;whetherthereisenoughprotectionfortheircreditor’srights(ownedwagesorcompensationforoccupationalaccident);whethertheyaretreatedassecond-classworkersatplacesthereareassignedtoanddisallowedequalaccesstofacilitiesandequipmentandemploymentinformation;andwhethertheyareunreasonablyusedforalongperiodwithoutgiventheopportunityofbecomingfull-timeemployees.Inthemeantime,should“registration-baseddispatch”existinTaiwanandallowdispatchedworkerstobedenigratedbythemediaas“disposablechopsticks”or“PETbottles?”AlltheabovewereissuestobeaddressedwhentheMOLtriedtodrawuptheDispatchedWorkerProtectionAct.Apparently,thisspeciallawwouldhavetoincludetheprinciplesofadoptionoflong-termdispatchsystems(fixed-termcontractsbetweenemployersanddispatchedworkerswouldbeforbidden),definitionofthejoint-employerresponsibilityofusingunits(workhourregulationandotherworkingconditionssetforthintheLaborStandardsAct,regulationsagainstdiscriminationsetforthintheEmploymentServiceActandregulationsongenderequalityandagainstsexualharassmentsetforthintheActofGenderEqualityinEmployment),protectionofdispatchedworkers’corecreditor’srights(jointresponsibilityforoccupationalaccidentcompensationandsupplementaryresponsibilityforarrearwages),protectionoftherighttoequaltreatmentfordispatchedworkers(equalworkforequalpay,equalaccesstofacilitiesandemploymentinformation),reasonablelimitationofdispatchedlabor(establishmentofthenegativelistandupperlimitoftotaldispatchedlabor),andregistrationandcontroloflabordispatchoperations. Theregulationsonestablishmentofthenegativelistandupperlimitoftotaldispatchedlaborthathavearousedpublicconcernhavetobeincludedmainlybecauseanumberoftypesofworkarecloselyrelatedtopublicsafetyandinterest.Afterconsultingwiththecompetentauthoritiesofvariousindustries,ithasbeendeterminedthatdispatchworkersmaynotbehiredtoreplacesixtypesofworkers(medicalpersonnel,securityguards,aviationcrewmembers,merchantmarinecrewmembers,publicpassengertransportdriversandminers)andothertypesofworkersannouncedbythecentralcompetentauthority.Althoughthisspeciallawwillincreasethecostsandlimitationsofuseofdispatchedworkers,theMOLhasyettoensureoveruseofdispatchedworkersbydifferententerprisescanbepreventedsothatthenumberofdispatchedworkerswillnotcontinuetoescalate.Therefore,theMOLhasreferredtothe2013ManpowerUtilizationSurveyconductedbytheDirectorate-GeneralofBudget,AccountingandStatistics.Thesaidsurveyindicatedthatthenumberof“temporaryordispatchedworkers”accountedfor5.39%ofthetotalnumberofemployedworkers.Meanwhile,the2011Industry,CommerceandServiceCensusrevealedthatthenumberofdispatchedworkerswas131thousand,makingup1.64%ofthetotalnumberofemployedworkers.Basedonthesestatistics,theMOLhasthereforeconcludedthatthetotalnumberofdispatchedworkerstobeusedbyeachusingunitsmaynotexceed3%ofitstotalnumberofemployedworkers. Toensurethatdispatchedworkerscanworkinsaferenvironment,theMOLstartedin2013topushforthelegislationofaspeciallaw.ThedraftDispatchedWorkerProtectionActwasreviewedandapprovedonAug.23,2013bytheLegalAffairsCommitteeofthethenCouncilofLabor.However,assomeoftheprovisionsstillrequiredperfection,thedraftwasnotpresentedtobereviewedbytheCouncilofLaborCommitteeatthetime.Afterconsultingmanyscholarsandspecialists,holdingseveralmeetingswithdispatchedworkers,visitinganumberofbusinessorganizationsandlaborunionsandcarefullyassessingthebenefitsandeffectsofthebill,theMOLfinallypresentedthedraftonFeb.6,2014tobereviewedbytheCouncilofLaborCommittee.TheCommitteeapprovedthedraftanditwasthenpresentedonFeb.12tobereviewedbytheExecutiveYuan.Manylegislators,laborunionsanddispatchedworkershavebeenhighlyconcernedaboutthelegislativeprogressoftheDispatchedWorkerProtectionActandhopedthattheMOLcancompletethelegislationasearlyaspossible. Thegovernmentcannotoverlookthefactthatlabordispatchexistsandthereisnotenoughprotectionfordispatchedworkers.SomelabororganizationsarestronglyagainsttheenactmentoftheDispatchWorkerProtectionAct,butthegovernment,consideringprotectionofdispatchedworkersitsresponsibility,willdoitsbesttocommunicatewithconcernedpartiestoeasetheirmisgivings.ItishopedthatallsectorscanworktogethertocompletethelegislationoftheDispatchedWorkerProtectionActfortherightsandinterestsofdispatchedworkersandallworkersinTaiwan.
