Itisoktotracefrom: Bing aerialimagery,asMicrosofthasgivenspecificpermission; averysmallamountofimageryfromlocalgovernmentagencies,asnegotiatedbylocalOpenStreetMapcommunities; out-of-copyrightmappingwithcompatibletermsofuse,usuallyhostedbyOSMcontributorsoronOSMservers. Betterstill,surveythedatayourself! 2b.XYZOrganisationhasdataforfreedownloadunderlicenceN.CanIuseitinOSM? Approachthedataowners,explainOSM,andseekwrittenpermissiontolicencetheirdataunderourlicenceandcontributorterms. Unlessthedataisgenuinelyofferedwithoutanyrestrictionsonuseatall(i.e.publicdomain),pleasecontactthe LicensingWorkingGroup foradvice.Donotrelyonyourownlegalinterpretationofthelicence.OSMisallaboutcreatingafreelyandeasilyredistributabledataset.AnythingwhichtaintsthedatasetorexposesOSMtopossiblelegalactioninterfereswiththatobjective. BecauseOpenStreetMap is itscontributors,youmayomittheword“contributors”ifspaceislimited. YoumayoptionallyqualifythecredittoexplainwhatOSMcontentyouareusing.Forexample,ifyouhaverenderedOSMdatatoyourowndesign,youmaywishtouse“Mapdata©OpenStreetMapcontributors”. Fora printedmap,thecreditshouldappearbesidethemapifthatiswhereothersuchcreditsappear,and/orinthe“acknowledgements”sectionofthepublication(oftenatthestartofabookormagazine). IfyouareproducinglibrarycodethatoffersOpenStreetMapdataortiles,youshouldmakesurelibraryusersareawareoftheseterms.Westronglyrecommendthatyoudisplaythiscreditbydefaultwhenyourlibraryisused. 3b.IfIhavedataderivedfromOSMdata,doIhavetodistributeit? Thelicensedoesnotforceyoutodistributeormakeanydataavailable. Butifyoudodistributeorpubliclyuseanythingderivedfromit–a DerivativeDatabase –thenthederivativedatabasemustbeavailableunderthesamelicenceastheOSMdata(theOpenDatabaseLicense).Youmustmakethederivativedatabaseavailableonrequesttoanyonewhoreceivedyourdata,viewedtheworkmadefromit,orusedyourservice.Youcoulddothisbyputtingitonasiteforfreedownload,orofferingyouruserstheoptionofemailingyouforacopy. Anyoftheseareacceptablewaysofmakingthederiveddataavailable: Thefulldatabase,asadumporinacommonlyunderstoodformat(e.g.OSMXMLorshapefiles); The‘diff’betweentheoriginalOSMdata,andyourderiveddatabase(i.e.amachine-readablelistofchanges); Instructionsonhowtomakethechanges,suchasanalgorithm,somesoftware,orsomethingassimpleasan Osmosis commandline. Ifyou’rethinkingofbuildingsomethingusingOSM,thereisa UseCases pagewhichgoesintodetailaboutthelicenseimplicationsinvariousdifferentscenarios. 3c.IfImakesomethingwithOSMdata,doInowhavetoapplyyourlicensetomywholework? No.Forexample,ifyouhavewrittenagameorpublishedanartisticmapwhichincludesOSMdata,onlythedataiscoveredbythelicense.Thisiscalleda ProducedWork. However,ifyoumakeadatabasewhichincludesOSMdataandanyadditionalinformation(includingusinginformationtodecideonOSMfeaturesNOTtoincludeinyourdatabase),thenthiswouldbeclassedasa“derivativedatabase”andshouldbemadeavailableundertheOpenDatabaseLicenseasin3babove. 3d.IfIuseyourdatatogetherwithsomeoneelse’sdata,doIhavetoapplyyourlicensetotheirdatatoo? Ifthetwodatasetsareindependent,no,youdon’t;thisisa CollectiveDatabase. Ifyouadaptthemtoworktogether(forexample,bytakingfootpathsfromtheOSMdata,roadsfromthethird-partydata,andconnectingthemforrouting),thisisaDerivativeDatabaseandsoyoumust(asper3b).However,ifthetwodatasetsarematched“trivially”by,forexample,automatedmatchingusingasimplecriterionsuchasname/locality,thisisnot“substantial”andremainsaCollectiveDatabase.Thereisa CommunityGuideline onwhatconstitutesatrivialtransformation. 3e.CanIchargefordistributingOSMdataordataderivedfromOSMdata? Yes.Youcanchargeanyamountofmoneyyouwantforanyserviceordatayouprovide.However,sincethedatathatisderivedfromOSMdatamustbelicensedasabove,otherpeoplemaythenredistributethiswithoutpayment. 3f.CanIgetpermissiontodistributeOSMdataunderanalternativelicence? Probablynot.ThecopyrighttoOSMdataisvestedintheindividualcontributors.However,ifyouhappentousedataprovidedsolelybyoneorafewOSMcontributors,youcanaskthemiftheyarewillingtoprovidetheirdatatoyouunderadifferentlicense. 3g.CanIuseOSMdataandOpenStreetMap-derivedmapstoverifymyowndatawithouttriggeringshare-alike? Yes,providedthatyouareonlycomparinganddonotcopyanyOpenStreetMapdata.Ifyoumakeanychangestoyourdataaftermakingthecomparison,youshouldbeabletoreasonablydemonstratethatanysuchchangewasmadeeitherfromyourownphysicalobservationorcomesfromanon-OpenStreetMapsourceaccesseddirectlybyyou.I.eyoucancomparebutnottake!
