Article2ThecompetentauthorityunderthisActistheMinistryofEconomicAffairs.TheMinistryofEconomicAffairsshallappointaspecializedagencyinchargeofcopyrightmatters. Article3ForthepurposesofthisActthefollowingdefinitionsshallapply:1."Work"meansacreationthatiswithinaliterary,scientific,artistic,orotherintellectualdomain.2."Author"meansapersonwhocreatesawork.3."Copyright"meansthemoralrightsandeconomicrightssubsistinginacompletedwork.4."Thepublic"or"apublic"meansunspecifiedpersonsormultiplespecifiedpersons;provided,thisdoesnotapplytomultiplepersonsofahouseholdandthehousehold'snormalsocialacquaintances.5."Reproduce"meanstoreproducedirectly,indirectly,permanently,ortemporarilyaworkbymeansofprinting,reprography,soundrecording,videorecording,photography,handwrittennotes,orotherwise.Thisdefinitionalsoappliestothesoundrecordingorvideorecordingofscripts,musicalworks,orworksofsimilarnatureduringtheirperformanceorbroadcast,andalsoincludestheconstructionofanarchitecturalstructurebasedonarchitecturalplansormodels.6."Publicrecitation"meanstocommunicatethecontentofaworktothepublicbyspokenwordsorothermeans.7."Publicbroadcast"meanstocommunicatetothepublicthecontentofaworkthroughsoundsorimagesbymeansoftransmissionofinformationbyabroadcastingsystemofwire,wireless,orotherequipment,wheresuchcommunicationisforthepurposeofdirectlisteningreceptionorviewingreceptionbythepublic.Thisincludesanycommunication,bytransmissionofinformationviaabroadcastingsystemofwire,wireless,orotherequipment,tothepublicofanoriginalbroadcastofsoundsorimagesbyanypersonotherthantheoriginalbroadcaster.8."Publicpresentation"meanstousesingle-ormultiple-unitaudiovisualdevices,orothermethodsoftransmittingimages,tosimultaneouslycommunicatethecontentofaworktothepublicattheplaceoftransmissionorataspecifiedplaceoutsidetheplaceoftransmission.9."Publicperformance"meanstoact,dance,sing,playamusicalinstrument,oruseothermeanstocommunicatethecontentofaworktoapublicthatispresentatthescene.Thisincludesanycommunicationtothepublicofanoriginalbroadcastofsoundsorimagesthroughloudspeakersorotherequipment.10."Publictransmission"meanstomakeavailableorcommuni-catetothepublicthecontentofaworkthroughsoundsorimagesbywireorwirelessnetwork,orthroughothermeansofcommunication,includingenablingthepublictoreceivethecontentofsuchworkbyanyoftheabovemeansatatimeorplaceindividuallychosenbythem.11."Adaptation"meanstocreateanotherworkbaseduponapre-existingworkbytranslation,musicalarrangement,revision,filming,orothermeans.12."Distribution"means,withorwithoutcompensation,toprovidetheoriginalofawork,oracopythereof,tothepublicforthepurposeoftradeorcirculation.13."Publicdisplay"meanstodisplaythecontentofaworktothepublic.14."Publication"meansdistributionbytherightsholderofasufficientnumberofcopiesofaworktosatisfyareasonablelevelofpublicdemand.15."Publicrelease"meanspublicissuebytherightsholderofthecontentofaworktothepublicthroughpublication,broadcast,presentation,recitation,performance,display,orothermeans.16."Theoriginal"or"anoriginal"meanstheobjecttowhichaworkisfirstfixed.17."Electronicrightsmanagementinformation"meanselectronicinformationpresentedontheoriginalorcopiesofawork,oratthetimeofcommunicationofcontentofaworktothepublic,sufficienttoidentifythework,thenameofthework,theauthor,theeconomicrightsholderorpersonlicensedthereby,andtheperiodorconditionsofexploitationofthework,includingnumbersorsymbolsthatrepresentsuchinformation.18.“Technologicalprotectionmeasures”meansequipment,de-vices,components,technologyorothertechnologicalmeansemployedbycopyrightownerstoeffectivelyprohibitorrestrictothersfromaccessingorexploitingworkswithoutauthori-zation.19."Internetserviceprovider"meansthosewhoprovidethefollowingservices:(1)Connectionserviceprovider:thosewhoprovideservices,bywireorwirelessmeans,oftransmitting,routing,orreceiving,informationthroughasystemornetworkcontrolledoroperatedbytheserviceprovider,oroftheintermediateandtransientstorageofinformationinthecourseofsuchtransmitting,routing,orreceiving.(2)Cachingserviceprovider:thosewho,afterinformationhasbeentransmittedattherequestofauser,provideservicesofintermediateandtemporarystorageoftheinformationthroughasystemornetworkcontrolledoroperatedbytheserviceprovider,forpurposesofprovidingacceleratedaccesstotheinformationbyuserswhosubsequentlyrequesttransmissionoftheinformation.(3)Informationstorageserviceprovider:thosewhoprovideinformationstorageservicesattherequestofauserthroughasystemornetworkcontrolledoroperatedbytheserviceprovider.(4)Searchserviceprovider:thosewhoprovideuserswithservices,includinganindex,reference,orhyperlink,tosearchorhyperlinktoonlineinformation."Placeoftransmissionorataspecifiedplaceoutsidetheplaceoftransmission"asreferredtoinsubparagraph8oftheprecedingparagraphincludesmotionpicturecinemas,clubs,placeswherevideocassetesorvideodiscsarepresented,hotelrooms,publictransportationvehicles,orotherplacesthatmaybeaccessedbyunspecifiedpersons. Article4WorksofforeignnationalsthatcomplywithoneofthefollowingconditionsmayenjoycopyrightunderthisAct;provided,wherethetermsofatreatyoranagreementthathasbeenratifiedbyresolutionoftheLegislativeYuanprovideotherwise,suchtermsshallgovern:1.WorksthatarefirstpublishedintheterritoryunderthejurisdictionoftheRepublicofChina,orarepublishedintheterritoryunderthejurisdictionoftheRepublicChinawithinthirtydaysaftertheirfirstpublicationinterritoryoutsidethejurisdictionoftheRepublicChina;provided,thisshallonlyapplywherethecountryofsuchforeignnationalextendsprotectionunderidenticalcircumstancestotheworksofpersonsoftheRepublicofChina,andsuchprotectionhasbeenverified.2.Wherebytreatyoragreement,orunderthedomesticacts,regulations,orstandardpracticeofthehomecountryoftheforeignnational,worksofpersonsoftheRepublicofChinaenjoycopyrightinsuchcountry. ChapterIIWorks Article5Forthepurposesofthisact,"works"shallincludethefollowing:1.Oralandliteraryworks.2.Musicalworks.3.Dramaticandchoreographicworks.4.Artisticworks.5.Photographicworks.6.Pictorialandgraphicalworks.7.Audiovisualworks.8.Soundrecordings.9.Architecturalworks.10.Computerprograms.Theexamplesandcontentofeachcategoryofworkssetforthintheprecedingparagraphshallbeprescribedbythecompetentauthority. Article6Acreationadaptedfromoneormorepre-existingworksisaderivativeworkandshallbeprotectedasanindependentwork.Protectionofaderivativeworkshallnotaffectthecopyrightinthepre-existingwork. Article7Acompilationworkisaworkformedbythecreativeselectionandarrangementofmaterials,andshallbeprotectedasanindependentwork.Protectionofacompilationworkshallnotaffectthecopyrightintheworkfromwhichthematerialwasselectedandarranged. Article7-1Aperformancebyaperformerofapre-existingworkorfolkloreshallbeprotectedasanindependentwork.Protectionofaperformanceshallnotaffectthecopyrightinthepre-existingwork. Article8Ajointworkisaworkthathasbeencompletedbytwoormorepersonswherethecreationofeachpersoncannotbeseparatelyexploited. Article9Thefollowingitemsshallnotbethesubjectmatterofcopyright:1.Theconstitution,acts,regulations,orofficialdocuments.2.Translationsorcompilationsbycentralorlocalgovernmentagenciesofworksreferredtointheprecedingsubparagraph.3.Slogansandcommonsymbols,terms,formulas,numericalcharts,forms,notebooks,oralmanacs.4.Oralandliteraryworksfornewsreportsthatareintendedstrictlytocommunicatefacts.5.Testquestionsandalternativetestquestionsfromallkindsofexaminationsheldpursuanttoactsorregulations.Theterm"officialdocuments"inthefirstsubparagraphoftheprecedingparagraphincludesproclamations,textofspeeches,newsreleases,andotherdocumentspreparedbycivilservantsinthecourseofcarryingouttheirduties. ChapterIIIAuthorsandCopyright Section1GeneralProvisions Article10Theauthorofaworkshallenjoycopyrightuponcompletionofthework;provided,wherethisActprovidesotherwise,suchprovisionsshallgovern. Article10-1ProtectionforcopyrightthathasbeenobtainedinaccordancewiththisActshallonlyextendtotheexpressionoftheworkinquestion,andshallnotextendtothework'sunderlyingideas,procedures,productionprocesses,systems,methodsofoperation,concepts,principles,ordiscoveries. Section2Authors Article11Whereaworkiscompletedbyanemployeewithinthescopeofemployment,suchemployeeistheauthorofthework;provided,whereanagreementstipulatesthattheemployeristheauthor,suchagreementshallgovern.Wheretheemployeeistheauthorofaworkpursuanttotheprovisionsoftheprecedingparagraph,theeconomicrightstosuchworkshallbeenjoyedbytheemployer;provided,whereanagreementstipulatesthattheeconomicrightsshallbeenjoyedbytheemployee,suchagreementshallgovern.Theterm"employee"intheprecedingtwoparagraphsincludescivilservants. Article12Whereaworkiscompletedbyapersonundercommission,exceptinthecircumstancessetoutintheprecedingarticle,suchcommissionedpersonistheauthorofthework;provided,whereanagreementstipulatesthatthecommissioningpartyistheauthor,suchagreementshallgovern.Wherethecommissionedpersonistheauthorpursuanttotheprovisionsoftheprecedingparagraph,enjoymentoftheeconomicrightstosuchworkshallbeassignedthroughcontractualstipulationtoeitherthecommissioningpartyorthecommissionedperson.Wherenostipulationregardingtheenjoymentofeconomicrightshasbeenmade,theeconomicrightsshallbeenjoyedbythecommissionedperson.Wheretheeconomicrightsareenjoyedbythecommissionedpersonpursuanttotheprovisionsoftheprecedingparagraph,thecommissioningpartymayexploitthework. Article13Whereaperson'snameorapseudonymfamiliartothepublicisrepresentedinanormalwayastheauthorontheoriginalofawork,oronapublishedcopyofthework,orinconnectionwithapublicreleaseofawork,thepersonshallbepresumedtobetheauthorofthework.Theprovisionsoftheprecedingparagraphshallapplymutatismutandistopresumptionsconcerningthedateandplaceofpublicationofaworkaswellastheownershipofeconomicrightstherein. Article14(deleted) Section3MoralRights Article15Theauthorofaworkshallenjoytherighttopubliclyreleasethework;provided,thisshallnotapplytoacivilservantwhere,pursuanttotheprovisionsofArticle11or12,suchpersonistheauthorwhilethejuristicpersonemployingsuchauthorenjoystheeconomicrightstothework.Inthefollowingcircumstancestheauthorshallbepresumedtohaveconsentedtothepublicreleaseofthework:1.Where,priortopubliclyreleasingitswork,theauthorhastransferred,orlicensedtoexploit,theeconomicrightstothework,andtheworkispubliclyreleasedasaconsequenceoftheexerciseorexploitationoftheeconomicrights.2.Where,priortothepublicreleaseofaartisticworkoraphotographicwork,theauthortransferstheoriginaloracopyofsuchworktoanotherpartyandthetransfereepubliclydisplaystheoriginalorcopyofthework.3.WheretheworkisaMastersthesisordoctoraldissertationwrittenunderthe"DegreeConferralAct"andtheauthorhasobtainedadegree.Where,inaccordancewiththeprovisionsofparagraph2ofArticle11orparagraph2ofArticle12,anemployeroracommissioningparty,abinitio,obtainedeconomicrightstoaworkthathasneverbeenpubliclyreleased,andwheresuchworkispubliclyreleasedinconjunctionwiththetransfer,exercise,orexploitationoftheeconomicrightsofsuchwork,theauthorshallbedeemedtohaveconsentedtothepublicreleaseofthework.Theprovisionsoftheprecedingparagraphshallapplymutatismutandistoparagraph3ofArticle12. Article16Theauthorofaworkshallhavetherighttoindicateitsname,apseudonym,ornonameontheoriginalorcopiesofthework,orwhentheworkispubliclyreleased.Theauthorhasthesamerighttoaderivativeworkbasedonitswork.Theprovisointhefirstparagraphoftheprecedingarticleshallapplymutatismutandistotheprecedingparagraph.Thepersonexploitingaworkmayuseitsowncoverdesignandmayaddthenameorappellationofthedesigneroreditor-in-chief;providedthisshallnotapplywheretheauthorhasspecificallyindicatedtothecontrary,orwheretheadditionwoulddeviatefromcommonlyacceptedpractices.Wherethepurposeandmethodofexploitationneitherpresentanylikelihoodofharmtotheauthor'sinterestsnordeviatefromcommonlyacceptedpractices,theauthor'snameorappellationmaybeomitted. Article17Theauthorhastherighttoprohibitothersfromdistorting,mutilating,modifying,orotherwisechangingthecontent,form,ornameofthework,therebydamagingtheauthor'sreputation. Article18Theprotectionofmoralrightsofanauthorwhohasdiedorbeenextinguishedshallbedeemedtobethesameaswhentheauthorwaslivingorinexistenceandshallnotbeinfringeduponbyanyperson;provided,theactshallnotconstituteaninfringementwhereitcanbeconsideredthattheauthor'sintenthasnotbeencontravenedgiventhenatureanddegreeoftheactofexploitation,socialchanges,orothercircumstances. Article19Moralrightsinajointworkmaynotbeexercisedwithouttheconsentofallthejointauthors.Ajointauthorshallnotrefuseconsentwithoutalegitimatereason.Authorsofajointworkmayselectanauthorfromamongthejointauthorstobetheirrepresentativeforthepurposeofexercisingmoralrights.Limitationsimposedontherepresentativepowersoftherepresentativereferredtointheprecedingparagraphshallnotbeeffectiveagainstathirdpartyactingingoodfaith. Article20Theoriginalofaworkthathasnotbeenpubliclyreleasedandtheeconomicrightsthereinshallnotbetheobjectofcompulsoryexecutionunlesstheyaretheobjectofatradeortheprincipalhasgivenitsconsent. Article21Moralrightsbelongexclusivelytotheauthorandshallnotbetransferredorsucceeded. Section4EconomicRights Subsection1CategoriesofEconomicRights Article22ExceptasotherwiseprovidedinthisAct,authorshavetheexclusiverighttoreproducetheirworks.Performershavetheexclusiverighttoreproducetheirperformancesbymeansofsoundrecording,videorecording,orphotography.Theprovisionsoftheprecedingtwoparagraphsdonotapplytotemporaryreproductionthatistransient,incidental,anessentialpartofatechnologyprocess,andwithoutindependenteconomicsignificance,wheresolelyforthepurposeoflawfulnetworkrelaytransmission,orforthelawfuluseofawork;provided,thisshallnotapplytocomputerprograms.Intheprecedingparagraph,thephrase"temporaryreproduction…forthepurposeoflawfulnetworkrelaytransmission"includestechnicallyunavoidablephenomenaofthecomputerormachineoccurringinnetworkbrowsing,caching,orotherprocessesforenhancingtransmissionefficiency. Article23Authorsoforalandliteraryworkshavetheexclusiverighttopubliclyrecitetheirworks. Article24ExceptasotherwiseprovidedinthisAct,authorshavetheexclusiverighttopubliclybroadcasttheirworks.Theprovisionsoftheprecedingparagraphshallnotapplytofurtherpublicbroadcastsofaperformanceafterthatperformancehasbeenreproducedorpubliclybroadcast. Article25Authorsofaudiovisualworkshavetheexclusiverighttopubliclypresenttheirworks. Article26ExceptasotherwiseprovidedinthisAct,authorsoforalandliterary,musical,anddramatic/choreographicworkshavetheexclusiverighttopubliclyperformtheirworks.Performershavetheexclusiveright,bymeansofloudspeakersorotherequipment,topubliclyperformtheirperformances;provided,thisshallnotapplytopublicperformancesofaperformancebymeansofloudspeakersorotherequipmentafterthatperformancehasbeenreproducedorpubliclybroadcast.Whereasoundrecordinghasbeenpubliclyperformed,theauthormayclaimpaymentofremunerationforusefromthepersonswhopubliclyperformedit. Article26-1ExceptasotherwiseprovidedinthisAct,authorsofworkshavetheexclusiverightofpublictransmissionoftheirworks.Performershavetheexclusiverightofpublictransmissionoftheirperformancesreproducedinsoundrecordings. Article27Authorsofunpublishedfineartsorphotographicworkshavetheexclusiverighttopubliclydisplaytheoriginalandcopiesoftheirworks. Article28Authorsofworkshavetheexclusiverighttoadapttheirworksintoderivativeworksortocompiletheirworksintocompilationworks;provided,thisshallnotapplytoperformances. Article28-1ExceptasotherwiseprovidedinthisAct,authorsofworkshavetheexclusiverighttodistributetheirworksthroughtransferofownership.Performershavetheexclusiverighttodistributetheirperformancesreproducedinsoundrecordingsthroughtransferofownership. Article29ExceptasotherwiseprovidedinthisAct,authorsofworkshavetheexclusiverighttorenttheirworks.Performershavetheexclusiverighttorenttheirperformancesreproducedinsoundrecordings. Article29-1Anemployerorcommissioningpartythathasobtainedtheeconomicrightsinaworkinaccordancewiththeprovisionsofparagraph2ofArticle11orparagraph2ofArticle12shallhaveexclusiveenjoymentoftherightssetoutintheprovisionsofArticles22through29. Subsection2TermofProtectionforEconomicRights Article30ExceptasotherwiseprovidedinthisAct,economicrightsendureforthelifeoftheauthorandfiftyyearsaftertheauthor'sdeath.Whereaworkisfirstpubliclyreleasedbetweenthefortiethandfiftiethyearsaftertheauthor'sdeath,theeconomicrightsshallendureforatermoftenyearsbeginningfromthetimeofthefirstpublicrelease. Article31Economicrightsinajointworksubsistforfiftyyearsafterthedeathofthelastsurvivingauthor. Article32Economicrightsinapseudonymousworkorananonymousworkendureforfiftyyearsfromthetimeofpublicrelease;provided,theeconomicrightsshallbeextinguishedwhereitcanbeproventhattheauthorhasbeendeceasedforoverfiftyyears.Theprovisionsoftheprecedingparagraphshallnotapplywhenthepseudonymoftheauthoriswellknowntothepublic. Article33Economicrightsinworksauthoredbyajuristicpersonendureforfiftyyearsafterthepublicreleaseofthework;provided,iftheworkisnotpubliclyreleasedwithinfiftyyearsfromthecompletionofthecreation,theeconomicrightsshallsubsistforfiftyyearsaftercompletionofthecreation. Article34Economicrightsforphotographicworks,audiovisualworks,soundrecordings,andperformancesendureforfiftyyearsafterthepublicreleaseofthework.Theprovisooftheprecedingarticleshallapplymutatismutandistotheprecedingparagraph. Article35AlltermsofdurationspecifiedinArticles30through34terminateasofthelastdayofthelastyearoftheterm.Wherethetermofeconomicrightsforworksreleasedtothepubliccontinuouslyorsuccessivelyiscalculatedonthebasisofthedateofthepublicreleaseofthework,ifeachpublicreleasecanconstituteanindependentwork,thetermofeconomicrightsofeachworkshallbecalculatedfromthedateofeachpublicrelease;ifeachpublicreleasecannotconstituteanindependentwork,thetermshallbecalculatedfromthedateofthepublicrelease(s)thatcanconstituteanindependentwork.Withrespecttothecircumstancesdescribedintheprecedingparagraph,ifthecontinuingparthasnotbeenpubliclyreleasedwithinthreeyearsofthedateofpublicreleaseofitsprecedingpart,thetermoftheeconomicrightsshallbecalculatedfromthedateofpublicreleaseofitsprecedingpart. Subsection3Transfer,Exercise,andExtinguishmentofEconomicRights Article36Economicrightsmaybetransferredinwholeorinparttoanotherpersonandmaybejointlyownedwithotherpersons.Thetransfereeofeconomicrightsobtainseconomicrightswithinthescopeofthetransfer.Thescopeofthetransferoftheeconomicrightsshallbeasstipulatedbytheparties;rightsnotclearlycoveredbysuchstipulationsshallbepresumedtohavenotbeentransferred. Article37Theeconomicrightsholdermaylicenseotherstoexploitthework.Theterritory,term,content,methodofexploitation,andotherparticularsofthelicenseshallbeasstipulatedbytheparties;particularsnotclearlycoveredbysuchstipulationsshallbepresumedtohavenotbeenlicensed.Thelicensereferredtointheprecedingparagraphshallnotbeaffectedbysubsequentassignmentorfurtherlicensingofeconomicrightsbytheeconomicrightsholder.Anon-exclusivelicenseemaynotsublicensetherightsinherentinthelicensetoanythirdpartyforexploitationwithouttheconsentoftheeconomicrightsholder.Anexclusivelicenseemay,withinthescopeofthelicense,exerciserightsinthecapacityofeconomicrightsholder,andmayperformlitigiousactsinitsownname.Theeconomicrightsholdermaynotexerciserightswithinthescopeofanexclusivelicense.Theprovisionsofparagraphs2through4shallnotapplytoanylicenseconferredpriortotheimplementationoftheNovember12,2001amendmenttothisAct.TheprovisionsofChapterVIIdonotapplyinthefollowingcircumstancesexceptforworkssubjecttothemanagementofcopyrightcollectivemanagementorganizations:1.Exploitationofdigitizedkaraokemachinesorjukeboxeswhichcontainlicensedduplication(s)ofmusicworksforpublicperformance;or2.Rebroadcastingworksofanoriginalbroadcast;or3.Communicatingthesoundsorimagesofanoriginalbroadcasttothepublicwithloudspeakerorotherequipment;or4.Communicatingtheworkstothepublicthroughpublicbroadcastingorsimultaneouspublictransmissionofadvertisement,byabroadcaster,withinwhichsuchworkshavebeenreproducedunderauthorization. Article38(deleted) Article39Whereeconomicrightsaretheobjectofapledge,unlessotherwisestipulatedatthetimethepledgeiscreated,theeconomicrightsholdermayexercisetheeconomicrightstothework. Article40Inthecaseofajointwork,eachauthor'sshareoftheownershipofsuchaworkshallbeasstipulatedbythejointauthors;wherenostipulationhasbeenmade,ownershipsharesshallbedeterminedaccordingtothedegreeofeachauthor'screativecontribution.Wherethedegreeofeachauthor'screativecontributionisnotclear,itshallbepresumedthateachauthorownsanequalshare.Whereanauthorofajointworkabandonsitsshareoftheownershipofthework,thatshareshallbeapportionedamongtheotherjointauthorsinproportiontotheirrespectiveshares.Theprovisionsoftheprecedingparagraphshallapplymutatismutandiswheretheauthorofajointworkdieswithnosuccessororisextinguishedwithnoreceiver. Article40-1Jointeconomicrightsinaworkshallnotbeexercisedexceptwiththeconsentofallthejointeconomicrightsholders;noeconomicrightsholdershalltransferitssharetoanotherpersonorestablishapledgeofitsshareinfavorofathirdpartywithouttheconsentofallotherjointeconomicrightsholders.Ajointeconomicrightsholdershallnotrefuseconsentwithoutalegitimatereason.Thejointeconomicrightsholdersofaworkmayselectarepresentativefromamongthemselvestoexercisetheireconomicrights.Limitationsimposedontherepresentativepowersofsuchrepresentativeshallnotbeeffectiveagainstathirdpartyactingingoodfaith.Thesecondandthirdparagraphsoftheprecedingarticleshallapplymutatismutandistojointownershipofeconomicrights. Article41Whereaneconomicrightsholdermakesasubmissiontoanewspaperormagazine,orlicensesthepublicbroadcastofthework,itshallbepresumed,unlessotherwisestipulated,thattheeconomicrightsholderhaslicensedoneprintingoronepublicbroadcastonly,andthatsaidprintingorbroadcastshallhavenoeffectonotherrightsbelongingtotheeconomicrightsholder. Article42Economicrightsareextinguisheduponexpirationofthetermofprotection.Economicrightsarealsoextinguishedwhereanyofthefollowingcircumstancesoccursduringthetermofprotection:1.Theeconomicrightsholderhasdiedandtheeconomicrights,forthatreason,divestbylawtothenationaltreasury.2.Theeconomicrightsholderisajuristicpersonthathasbeenextinguishedandtheeconomicrights,forthatreason,divestbylawtoalocalgovernment. Article43ExceptasotherwiseprovidedbythisAct,anypersonmayfreelyexploitaworkforwhichtheeconomicrightshavebeenextinguished. Subsection4LimitationsonEconomicRights Article44Withinareasonablescope,centralorlocalgovernmentagenciesmayreproducetheworkofanotherpersonifitisconsiderednecessaryforinternalreferenceforthepurposeoflegislationoradministration;provided,thisshallnotapplywheresuchreproductionwouldprejudicetheinterestsoftheeconomicrightsholderduetothetypeanduseoftheworkandthevolumeandmethodofreproduction. Article45Withinareasonablescope,andforthesolepurposeofusenecessarytojudicialproceedings,theworksofanotherpersonmaybereproduced.Theprovisooftheprecedingarticleshallapplymutatismutandistothecircumstancessetforthintheprecedingparagraph. Article46Withinareasonablescope,andwherenecessaryforthepurposeofteachinginschools,alllevelsoflegallyestablishedschoolsandtheirteachersmayreproducetheworksofanotherpersonwhichhavealreadybeenpubliclyreleased.TheprovisoofArticle44shallapplymutatismutandistothecircumstancessetforthintheprecedingparagraph. Article47Withinareasonablescope,andforthepurposeofpreparingpedagogicaltextsforwhichreviewandapprovalbyaneducationadministrativeagencyisrequiredbyactorregulation,orwhereaneducationadministrativeagencypreparespedagogicaltextsitself,theworksofanotherpersonthathavebeenpubliclyreleasedmaybereproduced,adapted,orcompiled.Theprovisionsoftheprecedingparagraphshallapplymutatismutandistothepreparationofsupplementaryteachingaidswhichareancillarytotheaforesaidtextbooksandwhichareexclusivelyprovidedtoteachersforteachingpurposes;provided,thisshallbelimitedtoeditingbythepreparerofsuchtextbooks.Withinareasonablescopeandforthepurposeofmeetingeducationalneeds,alllevelsoflegallyestablishedschoolsandeducationalinstitutionsmaypubliclybroadcasttheworksofanotherpersonthathavebeenpubliclyreleased.Inthecircumstancessetforthintheprecedingthreeparagraphstheexploiteroftheworkshallnotifytheeconomicrightsholderandpaycompensationforuse.Thelevelofcompensationshallbesetbythecompetentauthority. Article48Libraries,museums,historymuseums,sciencemuseums,artmuseums,andotherculturalinstitutionsopentothepublicmayreproduceworksintheircollectionsinanyofthefollowingcircumstances:1.Whereapatronrequestsreproductionofapartofaworkthathasbeenpubliclyreleased,orasinglearticlefromaseminarpaperorasinglearticlefromaperiodicalthathasbeenpubliclyreleased,providedthatthecopyisforpersonalresearchpurposesandislimitedtoonecopyperperson.2.Wherenecessarytopreservematerials.3.Wheretheworksinquestionareoutofprintordifficulttopurchase,andhavebeenrequestedbyanothersimilarinstitute. Article48-1Centralorlocalgovernmentagencies,educationalagenciesthathavebeenestablishedbylaw,orlibrariesopentothepublicmayreproduceabstractsappendedtothefollowingworkswheresuchworkshavebeenpubliclyreleased:1.Mastersthesesordoctoraldissertationswrittenunderthe"DegreeConferralAct,"wheretheauthorhasobtainedadegree.2.Academicpaperspublishedinperiodicals.3.Researchreportsorcollectionsofseminarpapersthathavebeenpubliclyreleased. Article49Whenreportingcurrenteventsbymeansofbroadcasting,photography,film,newspaper,network,orotherwise,worksthatareseenorheardinthecourseofthereportmaybeexploitedwithinthescopenecessarytothereport. Article50Workspubliclyreleasedinthenameofacentralorlocalgovernmentagencyorapublicjuristicpersonmay,withinareasonablescope,bereproduced,publiclybroadcast,orpubliclytransmitted. Article51Withinareasonablescope,wherefornonprofitusebyanindividualorafamily,aworkthathasbeenpubliclyreleasedmaybereproducedbyamachinethatiseitherlocatedinalibraryorisnotprovidedforpublicuse. Article52Withinareasonablescope,worksthathavebeenpubliclyreleasedmaybequotedwherenecessaryforreports,comment,teaching,research,orotherlegitimatepurposes. Article53Forthepurposeofexclusiveusebythevisuallyimpaired,learningdisabled,hearingimpairedorotherpersonswithaperceptualdisability,worksthathavebeenpubliclyreleasedmaybeexploitedbylocalorcentralgovernmentagencies,non-profitorganizationsandalllevelsoflegallyestablishedschools,bymeansoftranslation,Braille,sound-recording,digitaltransformation,verbalimagery,accompanyingsignlanguageorotherwise.Theprecedingparagraphshallbeappliedmutatismutandistothedisabledpersonsortheirguardiansreferredtointheprecedingparagraphforpersonalandnonprofitusebythedisabled.Thecopiesreproducedinaccordancewiththeprecedingtwoparagraphsmaybedistributedorpubliclytransmittedamongthedisabledpersons,localorcentralgovernmentagencies,non-profitorganizationsandalllevelsoflegallyestablishedschoolsasprescribedintheprecedingtwoparagraphs. Article56Forthepurposesofpublicbroadcasting,aradioortelevisionbroadcastingorganizationmay,withitsownequipment,soundrecordorvideorecordawork;provided,thisshallbelimitedtosituationswherethepublicbroadcastinghasbeenlicensedbytheeconomicrightsholder,orsituationsotherwisecomportingwiththeprovisionsofthisAct.Exceptwherepreservationoftherecordingreferredtointheprecedingparagraphhasbeenapprovedforadesignatedplacebythespecializedagencyinchargeofcopyrightmatters,suchsoundorvideorecordingsshallbedestroyedwithinsixmonthsfromthetimeofrecording. Article56-1Forthepurposeofenhancingreceivingeffect,acommunityantennainstalledinaccordancewithlawmaysimultaneouslyrebroadcastworksbroadcastbywirelesstelevisionstationsestablishedinaccordancewithlaw;theformandcontentofsuchbroadcastsshallnotbechanged. Article57Theowneroftheoriginallegalcopyofanartisticworkorphotographicwork,orapersonauthorizedbytheowner,maypubliclydisplaysuchoriginalorlegalcopyofthework.Thepublicdisplayerreferredtointheprecedingparagraphmayreproducetheworkinadescriptivewritinginordertoprovideviewerswithanexplanationorintroduction. Article58Artisticworksorarchitecturalworksdisplayedonalong-termbasisonstreets,inparks,onoutsidewallsofbuildings,orotheroutdoorlocalesopentothepublic,maybeexploitedbyanymeansexceptunderthefollowingcircumstances:1.Reproductionofabuildingbyconstructionofanotherbuilding.2.Reproductionofaworkofsculpturebyproductionofanothersculpture.3.Reproductionforthepurposeoflong-termpublicdisplayinlocalesspecifiedinthisarticle.4.Reproductionofartisticworkssolelyforthepurposeofsellingcopies. Article59Theownerofalegalcopyofacomputerprogrammayaltertheprogramwherenecessaryforutilizationonamachineusedbysuchowner,ormayreproducetheprogramasnecessaryforbackup;provided,thisislimitedtotheowner'spersonaluse.Iftheownerreferredtointheprecedingparagraphlosesownershipoftheoriginalcopyforanyreasonotherthanthedestructionorlossofthecopy,allalteredandbackupcopiesshallbedestroyedunlesstheeconomicrightsholdergrantsitsconsentotherwise. ChapterVCopyrightCollectiveManagementOrganizationsandCopyrightReviewandMediationCommittees Article81Economicrightsholdersmay,withtheapprovalofthespecializedagencyinchargeofcopyrightmatters,establishcopyrightcollectivemanagementorganizationsforthepurposeofexercisingrightsorforcollectinganddistributingcompensationforuse.Exclusivelicenseesmayalsojoincopyrightcollectivemanagementorganizations.Theapprovalforestablishmentandtheorganizationandcapacitiesoftheorganizationsreferredtoinparagraph1,aswellasthesupervisionandguidancethereof,shallbeotherwiseprovidedforbyact. Article82ThespecializedagencyinchargeofcopyrightmattersshallestablishaCopyrightReviewandMediationCommitteetohandlethefollowingmatters:1.Examinationofratesofcompensationforuseundertheprovisionsofparagraph4ofArticle47.2.Mediationofdisputesbetweencopyrightcollectivemanagementorganizationsandusersconcerningcompensationforuse.3.Mediationofdisputesconcerningcopyrightorplaterights.4.Otherconsultationinconnectionwithcopyrightexaminationandmediation.Disputemediationreferredtoinsubparagraph3oftheprecedingparagraph,wheninvolvingcriminalmatters,shallbelimitedtocasesactionableonlyuponcomplaint. Article82-1Withinsevendaysofthedateoftheconclusionofamediationsettlement,thespecializedagencyinchargeofcopyrightmattersshallsubmitthewrittenmediationsettlementstatementforreviewbythecourtofjurisdiction.Thecourtshallreviewthewrittenmediationsettlementstatementreferredtointheprecedingparagraphwithduedispatch.Unlessitiscontrarytoactorregulation,publicorder,orgoodmorals,orcompulsoryexecutionwouldbeimpossible,thejudgeshallsign[copies]thereofandaffixthesealofthecourtthereto,andshallreturnthemediationsettlementstatementtothespecializedagencyinchargeofcopyrightmattersforservicetotheparties,retainingonecopyforitsownrecords.Wherethecourtdecidesnottoratifyamediationsettlementstatement,itshallnotifythespecializedagencyinchargeofcopyrightmattersofthereasons. Article82-2Afteramediationsettlementhasbeenratifiedbyacourt,thepartiesshallnotinitiateanyfurtherpublicorprivateprosecutionoractionwithrespecttothemediatedmatter.Acivilmediationsettlementratifiedbyacourtasreferredtointheprecedingparagraphshallhavethesameforceasafinalandunappealablecourtjudgmentinacivilcase.Withrespecttoacriminalmediationsettlementthathasbeenratifiedbyacourt,wherethesubjectmatterispaymentofacertainamountofmoney,orothersubstitutetherefore,orsecurities,thewrittenmediationsettlementstatementshallconstituteawritofexecution. Article82-3Whereacivilmediationsettlementhasbeenconcluded,andthenratifiedbyacourtwhilethecivilactionisunderlitigation,andwherenofinalandunappealablecourtjudgmenthasyetbeenobtained,thecivilactionshallbedeemedwithdrawnasofthedateoftheconclusionofthemediationsettlement.Whereacriminalmediationsettlementhasbeenconcluded,andthenratifiedbyacourtwhilethecriminalcaseisintheinvestigationstageorbeforetheconclusionofargumentsinthetrialoffirstinstance,andwherethepartieshaveagreedtowithdrawthecase,thecomplaintorprivateprosecutionshallbedeemedwithdrawnasofthedateoftheconclusionofthemediationsettlement. Article82-4Shouldthereexistanygroundforinvalidationorvoidanceofacivilmediationsettlementafterratificationbyacourt,thepartiesmayfileanactionwiththeoriginalratifyingcourttoinvalidateorvoidthemediationsettlement.Theactionreferredtointheprecedingparagraphshallbeinitiatedbythepartieswithin30daysofserviceofthewrittenmediationsettlementstatementratifiedbythecourt. Article83TheorganiccharterfortheCopyrightExaminationandMediationCommitteereferredtoinArticle82,andtheregulationsconcerningdisputemediation,shallbedraftedbythecompetentauthorityandpromulgatedafterreviewandapprovalbytheExecutiveYuan. ChapterVIRemediesforInfringementofRights Article84Thecopyrightholderortheplaterightsholdermaydemandremovalofinfringementofitsrights.Wherethereislikelihoodofinfringement,ademandmaybemadetopreventsuchinfringe-ment. Article85Apersonwhoinfringesonthemoralrightsofanauthorshallbeliablefordamages.Intheeventofnon-pecuniaryinjury,theinjuredpartymayclaimacommensurateamountofcompen-sation.Ininfringementmattersreferredtointheprecedingpara-graphtheinjuredpartymaydemandindicationoftheauthor'snameorappellation,correctionofcontent,oradoptionotherappropriatemeasuresnecessaryfortherestorationofitsreputation. Article86Afterthedeathoftheauthor,unlessotherwisespecifiedbyawill,thefollowingpersons,intheorderindicated,shallbeentitledtorequestremediesinaccordancewithArticle84andthesecondparagraphoftheprecedingarticleforactualorlikelyviolationsofArticle18:1.Spouses2.Children3.Parents4.Grandchildren5.Brothersandsisters6.Grandparents Article87Anyofthefollowingcircumstances,exceptasotherwiseprovidedunderthisAct,shallbedeemedaninfringementofcopyrightorplaterights:1.Toexploitaworkbymeansofinfringingonthereputationoftheauthor.2.Distributionofarticlesthatareknowntoinfringeonplaterights,orpublicdisplayorpossessionofsucharticleswiththeintenttodistribute.3.Importofanycopiesreproducedwithouttheauthorizationoftheeconomicrightsholderortheplaterightsholder.4.Importoftheoriginaloranycopiesofaworklegallyreproducedabroadwithouttheauthorizationoftheeconomicrightsholder.5.Exploitationforbusinesspurposesofacopyofacomputerprogramthatinfringesoneconomicrightsinsuchcomputerprogram.6.Distribution,byanymeansotherthantransferofownershiporrental,articlesthatareknowntoinfringeoneconomicrights;orpublicdisplayorpossession,withtheintenttodistribute,ofarticlesthatareknowntoinfringeoneconomicrights.7.Toprovidetothepubliccomputerprogramsorothertechnologythatcanbeusedtopubliclytransmitorreproduceworks,withtheintenttoallowthepublictoinfringeeconomicrightsbymeansofpublictransmissionorreproductionbymeansoftheInternetoftheworksofanother,withouttheconsentoforalicensefromtheeconomicrightsholder,andtoreceivebenefittherefrom.8.Knowingthattheworksbroadcastortransmittedpubliclybyanotherpersoninfringeeconomicrights,withtheintenttoprovidethepublictoaccesssuchworksbytheInternet,actingasfollows,andtoreceivebenefittherefrom:(1)ToprovidethepublicwithcomputerprogramswhichhaveaggregatedtheInternetProtocolAddressesofsuchworks.(2)Todirect,assistorpresetpathstothepublicforusingcomputerprogramsintheprecedingitem.(3)Tomanufacture,importorsellequipmentordevicespreloadedwiththecomputerprogramsofthefirstitem.Apersonwhoundertakestheactionssetoutinsubparagraphs7or8aboveshallbedeemedtohave"intent"pursuanttothatsubparagraphwhentheadvertisingorotheractivemeasuresemployedbythepersoninstigates,solicits,incites,orpersuadesthepublictousethecomputerprogramorothertechnologyprovidedbythatpersonforthepurposeofinfringingupontheeconomicrightsofothers. Article87-1Theprovisionsofsubparagraph4oftheprecedingarticledonotapplyunderanyofthefollowingcircumstances:1.Wheretheoriginalorcopiesofaworkareimportedfortheuseofcentralorlocalgovernmentagencies;provided,thisdoesnotapplytoimportforuseinschoolsorothereducationalinstitutions,ortotheimportofanyaudiovisualworkforpurposesotherthanarchivaluse.2.Wheretheoriginaloraspecifiednumberofcopiesofanyaudiovisualworksareimportedinordertosupplysuchworkstononprofitscholarly,educational,orreligiousorganizationsforarchivalpurposes,orwhereanoriginalorspecifiednumberofcopiesofworksotherthanaudiovisualworksareimportedforlibrarylendingorarchivalpurposes,providedthatsuchcopiesareusedincompliancewiththeprovisionsofArticle48.3.Wheretheoriginaloraspecifiednumberofcopiesofaworkareimportedfortheprivateuseoftheimporter,notfordistribution,orwheresuchimportoccursbecausetheoriginalorcopiesformpartofthepersonalbaggageofapersonarrivingfromoutsidetheterritory.4.Forthepurposeofexclusiveusebythevisuallyimpaired,learningdisabled,hearingimpairedorotherpersonswithaperceptualdisability,localorcentralgovernmentagencies,non-profitorganizationsandalllevelsoflegallyestablishedschoolsmayimportcopiesreproducedbymeansoftranslation,Braille,sound-recording,digitaltransformation,verbalimagery,accompanyingsignlanguageorotherwise,providedthatsuchcopiesareusedincompliancewiththeprovisionsofArticles53.5.Wheretheoriginalorcopiesofaworkincorporatedintoanylegallyimportedgoods,machinery,orequipmentareimportedinconjunctionwiththeimportofsuchitems.Suchoriginalorcopiesoftheworkshallnotbereproducedduringtheuseoroperationofthegoods,machineryorequipment.6.Whereauser'smanualoroperatingmanualaccompanyinganylegallyimportedgoods,machinery,orequipmentisimported;provided,thisdoesnotapplywheretheuser'smanualoroperatingmanualaretheprincipalobjectsoftheimportation.The"specifiednumber"setforthinsubparagraphs2and3oftheprecedingparagraphshallbeprescribedbythecompetentauthority. Article88Apersonwhounlawfullyinfringesonanotherperson'seconomicrightsorplaterightsoutofintentionornegligenceshallbeliablefordamages.Wheremultiplepersonsengageinunlawfulinfringement,theyshallbearjointandseveralliabilityfordamages.Withregardtothedamagesreferredtointheprecedingparagraph,theinjuredpartymaymakeclaiminanyofthefollowingmanners:1.InaccordancewiththeprovisionsofArticle216oftheCivilCode;provided,whentheinjuredpartyisunabletoprovedamages,itmaybasethedamagesonthedifferencebetweentheamountofexpectedbenefitfromtheexerciseofsuchrightsundernormalcircumstancesandtheamountofbenefitfromtheexerciseofthesamerightsaftertheinfringement.2.Basedontheamountofbenefitobtainedbytheinfringeronaccountoftheinfringingactivity;provided,wheretheinfringerisunabletoestablishcostsornecessaryexpenses[oftheinfringingactorarticles],thetotalrevenuederivedfromtheinfringementshallbedeemedtobeitsbenefit.Ifitisdifficultfortheinjuredpartytoproveactualdamagesinaccordancewiththeprovisionsoftheprecedingparagraph,itmayrequestthatthecourt,basedontheseriousnessofthematter,setcompensationatanamountofnotlessthantenthousandandnotmorethanonemillionNewTaiwanDollars.Ifthedamagingactivitywasintentionalandthematterserious,thecompensationmaybeincreasedtofivemillionNewTaiwanDollars. Article88-1WhereclaimismadepursuanttoArticle84orparagraph1oftheprecedingArticle,theinjuredpartymayrequestthedestructionorothernecessarydispositionofgoodsproducedasaresultoftheinfringingact,orofarticlesusedpredominantlyforthecommissionofinfringingacts. Article89Theinjuredpartymaydemandthattheinfringer,atitsownexpense,publishinanewspaperormagazineallorpartofajudgmentconcerningsaidinfringement. Article89-1TherighttoclaimdamagesasspecifiedinArticles85and88shallbeextinguishedifnotexercisedwithintwoyearsfromthetimethepersonhavingtherighttomakeclaimlearnsofitsrighttoclaimdamagesandknowstheidentityoftheobligor,orwithintenyearsoftheoccurrenceoftheinfringement. Article90Eachholderofcopyrightsinajointworkmay,pursuanttotheprovisionsofthischapter,separatelydemandremediesfromtheinfringer,andmayalsoclaimdamagesbasedonitsshareofcopyrightownership.Theprovisionsoftheprecedingparagraphshallapplymutatismutandistojointholdersofeconomicrightsandplaterightsthatariseoutofotherrelationships. Article90-1Acopyrightholderorplaterightsholdermayapplytothecustomsauthoritiestosuspendthereleaseofimportorexportgoodsthatinfringeontheircopyrightorplaterights.Theapplicationreferredtointheprecedingparagraphshallbefiledinwriting,shallstatethefactsoftheinfringement,andshallincludeabondinanamountequivalenttotheimportcustomsvalueortheexportFOBvalueofthegoods,asassessedbycustoms,toserveasasecuritytooffsetthelosssufferedbythepartywhosegoodsaresubjecttoattachment.Customsshallimmediatelyinformtheapplicantwhenprocessinganapplicationtosuspendthereleaseofgoods.WhereCustomsdeterminesthattheconditionsintheprecedingparagraphhavebeenmetandissuesanattachmentorder,itshallgivewrittennotificationtotheapplicantandtothepartywhosegoodsareattached.Theapplicantorthepartywhosegoodsareattachedmayapplytothecustomsauthoritiesforpermissiontoinspecttheattachedgoods.Attachedgoodsshallbeconfiscatedbythecustomsauthoritieswheretheapplicanthasobtainedafinalandunappealableciviljudgmentdeterminingthatthegoodsinfringeoncopyrightorplaterights.Theowneroftheattachedgoodsshallbeheldliableforsuchcostsascontainerdemurrage,warehousing,loading,unloading,aswellasforexpensesconnectedwithdestructionofthegoods.Iftheexpensesconnectedwithdestructionofthegoodsreferredtointheprecedingparagrapharenotpaidwithintheperiodprescribedbycustomsauthorities,theclaimshallbeenforcedthroughcompulsoryexecution.Inanyofthefollowingcircumstances,anattachmentordershallberescindedbythecustomsauthoritiesandtheattachedgoodsshallbeprocessedinaccordancewithapplicableimportandexportregulations;inaddition,theapplicantshallcompensatethepartywhosegoodswereattachedfordamageincurredonaccountoftheattachment:1.Theattachedgoodshavebeendeterminedtobenon-infringingofcopyrightorplaterightsbyafinalandunappealablecourtjudgment.2.Withintwelvedaysofthedateonwhichtheapplicantisinformedoftheattachment,thecustomsauthoritieshavenotreceivednotificationfromtheapplicantindicatingthatithasinitiatedlitigationproceedingsallegingthattheattachedgoodsareininfringement.3.Theapplicantappliestorescindtheattachment.Theperiodreferredtoinsubparagraph2oftheprecedingparagraphmaybeextendedbyanothertwelvedaysifcustomsauthoritiesdeemitnecessary.Customsauthoritiesshallreturnthebondupontheapplicant'srequestinanyofthefollowingcircumstances:1.Thereisnoneedtocontinuepostingthebondeitherbecausetheapplicanthasobtainedafinalandunappealablejudgmentinitsfavororbecausetheapplicanthasreachedasettlementwiththepartywhosegoodswereattached.2.Theattachmentorderhasbeenrescindedandtheapplicantcanprovethatatleasttherequiredtwentydayshaveelapsedsincetheapplicantnotifiedthepartywhosegoodsaresubjecttothesuspensionofreleasetoexerciseitsrightsandsuchpartyhasfailedtoexerciseitsrights.3.Thepartywhosegoodswereattachedagreestothereturn.Apersonwhosegoodshavebeenattachedshallhavethesamerightsasapledgeewithrespecttothebondreferredtointhesecondparagraphofthisarticle.Whenthecustomsauthorities,inthecourseofexecutingtheirduties,discoverimport/exportgoodsthatinappearanceareobviouslysuspectofcopyrightinfringement,theymaywithinonebusinessdaynotifytherightsholderandnotifytheimporter/exportertoproduceauthorizationmaterials.Afterreceivingnotice,therightsholdershallproceedtocustomswithinfourhoursforairexportgoodsandwithinonebusinessdayforairimportgoodsandseaimport/exportgoodstoassistwithverification.Wheretherightsholderisunknownorcannotbenotified,ortherightsholderfailstoproceedtocustomswithinthetimelimitasnotifiedtoassistwithverification,ortherightsholderdeterminesthatthegoodsinquestionarenotinfringing,andifthereisnoviolationofothercustomsclearanceregulations,customsshallreleasethegoodsforthwith.Wherethegoodsaredeterminedtobesuspectedinfringinggoods,customsshalltakemeasurestosuspendthereleaseofthegoods.Ifwithinthreebusinessdaysaftercustomshastakenmeasurestosuspendthereleaseofthegoodstherightsholderhasnotappliedtocustomsforattachmentunderparagraphs1to10,orhasnotinitiatedcivilorcriminallitigationproceduretoprotecttherights,andifthereisnoviolationofothercustomsclearanceregulations,customsshallreleasethegoodsforthwith. Article90-2TheimplementingregulationsfortheprecedingarticleshallbeprescribedbythecompetentauthorityinconsultationswiththeMinistryofFinance. Article90-3WhoeverviolatesanyprovisionofArticle80bisorArticle80ter,therebycausingdamagetothecopyrightowner,shallbeliablefordamages.Iftherearemultipleviolators,theyshallbearjointandseveralliabilityfordamages.TheprovisionsofArticle84,Article88bis,Article89bis,andArticle90bisshallapplymutatismutandistoviolationsofArticle80bisorArticle80ter. ChapterVI-1LimitationsonLiabilityforInternetServiceProviders Article90-4AnInternetserviceprovidershallbeentitledtotheapplicationofArticle90sexiestoArticle90noviesregardingthelimitationonliabilityonlyiftheserviceprovider—1.bycontract,electronictransmission,automaticdetectivesystemorothermeans,informsusersofitscopyrightorplaterightprotectionpolicy,andtakesconcreteactiontoimplementit;and2.bycontract,electronictransmission,automaticdetectivesystemorothermeans,informsusersthatintheeventofrepeatallegedinfringementsuptothreetimestheserviceprovidershallterminatetheserviceinwholeorinpart;and3.publiclyannouncesinformationregardingitscontactwindowforreceiptofnotificationdocuments.4.accommodateandimplementthetechnicalmeasuredescribedinparagraph3.Aconnectionserviceproviderthat,afterreceivingnotificationbyacopyrightholderorplaterightsholderofallegedinfringementbyauser,hasforwardedthenotificationtothatparticularuserbyelectronicmailisdeemedtohavemettherequirementintheprecedingparagraph,subparagraph1.Ifacopyrightholderorplaterightsholderhasprovidedtechnicalmeasureswhichhavebeendevelopedbasedonabroadconsensusandareusedtoidentifyorprotectcopyrightedorplate-rightedworks,theInternetserviceprovidershallaccommodateandimplementthemeasuresifthetechnicalmeasureshasbeenratifiedbythecompetentauthority. Article90-5Aconnectionserviceprovidershallnotbeliablefordamagesforinfringementofthecopyrightorplaterightsofanotherbyauserofitsserviceif—1.thetransmissionoftheinformationwasinitiatedbyorattherequestoftheuser;and2.thetransmission,routing,provisionofconnections,orstorageiscarriedoutthroughanautomatictechnicalprocess,withoutanyselectionofthematerialormodificationofitscontentbytheconnectionserviceprovider. Article90-6Acachingserviceprovidershallnotbeliablefordamagesforinfringementofthecopyrightorplaterightsofanotherbyauserofitsserviceif—1.theserviceproviderdoesnotmakeanymodificationtothecachedinformation;2.whenthepersonwhomadetheoriginalinformationavailablesubsequentlyupdate,deletes,orblocksaccesstoit,thecachedinformationisdoneinthesamewayasaresultofanautomatictechnicalprocess;and3.theserviceproviderrespondsexpeditiouslytoremove,ordisableaccessto,theallegedlyinfringingcontentorrelatedinformationuponnotificationbyacopyrightholderorplaterightsholderoftheallegedinfringementbytheuseroftheserviceprovider. Article90-7Aninformationstorageserviceprovidershallnotbeliablefordamagesforinfringementofthecopyrightorplaterightsofanotherbyauserofitsserviceiftheserviceprovider—1.doesnothaveknowledgeoftheallegedlyinfringingactivityoftheuser;2.doesnotreceiveafinancialbenefitdirectlyattributabletotheinfringingactivityoftheuser;and3.respondsexpeditiouslytoremove,ordisableaccessto,theallegedlyinfringingcontentorrelatedinformationuponnotificationbyacopyrightholderorplaterightsholderoftheallegedinfringementbytheuseroftheserviceprovider. Article90-8Asearchserviceprovidershallnotbeliablefordamagesforinfringementofthecopyrightorplaterightsofanotherbyauserofitsserviceiftheserviceprovider—1.doesnothaveknowledgethatthesearchedorlinkedinformationmaybeinfringing;2.doesnotreceiveafinancialbenefitdirectlyattributabletotheinfringingactivityoftheuser;and3.respondsexpeditiouslytoremove,ordisableaccessto,theallegedlyinfringingcontentorrelatedinformationuponnotificationbyacopyrightholderorplaterightsholderoftheallegedinfringementbytheuseroftheserviceprovider. Article90-9AninformationstorageserviceprovidershallforwardnoticetotheallegedlyinfringinguserofanymeasurestakenunderArticle90octies,subparagraph3,bythecontactmethodstipulatedbetweentheserviceproviderandtheuserorbythecontactinformationleftbytheuser.However,thisrequirementshallnotapplyifthenatureoftheserviceprovidedmakessuchnoticeimpossible.Ifauserreferredtointheprecedingparagraphbelievesthatthematerialswerenotinvolvedininfringement,theusermaysubmitcounternotificationdocumentstotheinformationstorageserviceproviderwitharequesttorestoretheremovedcontentorrelatedinformationorrestoretheaccesstoit.Uponreceiptofacounternotificationdescribedintheprecedingparagraph,aninformationstorageserviceprovidershallexpeditiouslyforwardsuchdocumentstothecopyrightholderorplaterightsholder.If,within10businessdayssinceonedayafterthedateofreceivingcounternotificationfromtheinformationstorageserviceproviderasdescribedintheprecedingparagraph,thecopyrightholderorplaterightsholderprovidestheinformationstorageserviceproviderwithevidenceregardingfilingcivilorcriminallitigationagainsttheuser,theinformationstorageserviceprovidershallnotbearanyobligationtorestorethecontentorrelatedinformation.Ifthecopyrightholderorplaterightsholderfailstoprovideevidenceonfilinglitigationinaccordancewiththeprecedingparagraph,theinformationstorageserviceprovidershall,withinnomorethan14businessdayssinceonedayafterthedateofforwardingthecounter-notificationdocuments,restoretheremovedcontentorrelatedinformationorrestoretheaccesstoit.However,ifrestorationisimpossible,theserviceprovidershallnotifytheuserinadvance,orprovideanotherappropriatemethodbywhichtheusermayrestoreit. Article90-10AnInternetserviceprovidershallnotbeliablefordamagestotheallegedlyinfringinguseriftheserviceprovider—1.removes,ordisablesaccessto,theallegedlyinfringingcontentorrelatedinformationinaccordancewithArticles90septiesto90novies;or2.uponobtainingknowledgeofsuspectedinfringementbytheuser,actsingoodfaithbelieftoremove,ordisableaccessto,theallegedlyinfringingcontentorrelatedinformation. Article90-11ApersonwhomisrepresentsanInternetserviceproviderwithanotificationorcounternotificationoutofintentionornegligenceshallbeliablefordamagesforanyinjuryincurredontheuser,copyrightholder,platerightholderorInternetServiceProvider. Article90-12TheinformationinconnectionwiththepublicannouncementofthecontactwindowunderArticle90quinquies,andthecontentofthenotificationandcounternotification,requiredparticulars,supplementationorcorrection,andotherrequisitemattersunderArticles90septiesthrough90deciesshallbeprescribebythecompetentauthority. ChapterVIIPenalProvisions Article91Apersonwhoinfringesontheeconomicrightsofanotherpersonbymeansofreproducingtheworkwithoutauthorizationshallbepunishedbyimprisonmentfornotmorethanthreeyears,detention,orinlieuthereoforinadditiontheretoafinenotmorethansevenhundredandfiftythousandNewTaiwanDollars.Apersonwhoinfringesontheeconomicrightsofanotherpersonbymeansofreproducingtheworkwithoutauthorizationwiththeintenttosellorrentshallbeimprisonednotlessthansixmonthsandnotmorethanfiveyears,andinadditionthereto,maybefinednotlessthantwohundredthousandandnotmorethantwomillionNewTaiwanDollars.Apersonwhocommitstheoffenseintheprecedingparagraphbymeansofreproducingontoanopticaldiskshallbeimprisonednotlessthansixmonthsandnotmorethanfiveyears,andinadditionthereto,maybefinednotlessthanfivehundredthousandandnotmorethanfivemillionNewTaiwanDollars.Aworkonlyforpersonalreferenceorfairuseofaworkdoesnotconstituteinfringementofcopyright. Article91-1Apersonwhoinfringesontheeconomicrightsofanotherpersonbydistributingtheoriginalofaworkoracopythereofbytransferofownershipwithoutauthorizationshallbepunishedbyimprisonmentfornotmorethanthreeyears,detention,orinlieuthereoforinadditionthereto,afinenotmorethanfivehundredthousandNewTaiwanDollars.Apersonwhodistributesorwithintenttodistributepubliclydisplaysorpossessesacopyknowingthatitinfringesoneconomicrightsshallbeimprisonednotmorethanthreeyearsand,inadditionthereto,maybefinednotlessthanseventythousandandnotmorethansevenhundredandfiftythousandNewTaiwanDollars.Apersonwhocommitstheoffenseintheprecedingparagraphandtheinfringingcopyisopticaldiskshallbeimprisonednotlessthansixmonthsandnotmorethanthreeyearsand,inadditionthereto,maybefinednotlessthantwohundredthousandandnotmorethantwomillionNewTaiwanDollars;provided,thisshallnotapplytoopticaldisksimportedinviolationofsubparagraph4ofArticle87.Punishmentofanoffenseintheprecedingtwoparagraphsmaybereducediftheoffenderconfessesthesourceofthegoods,resultingintheuncoveringthereof. Article92Apersonwhoinfringesontheeconomicrightsofanotherpersonwithoutauthorizationbymeansofpublicrecitation,publicbroadcast,publicpresentation,publicperformance,publictransmission,publicdisplay,adaptation,compilation,orleasing,shallbepunishedbyimprisonmentfornotmorethanthreeyears,detention,orinlieuthereoforinadditiontheretoafinenotmorethansevenhundredandfiftythousandNewTaiwanDollars. Article93Inanyofthefollowingcircumstances,asentenceofuptotwoyearsimprisonmentordetentionshallbeimposed,orinlieuthereoforinadditionthereto,afineofnotmorethanfivehundredthousandNewTaiwanDollars:1.Infringementoftheauthor'smoralrightsassetforthintheprovisionsofarticles15through17.2.ViolationsoftheprovisionsofArticle70.3.Infringementofanotherperson'scopyrightbyanyofthemeansspecifiedinparagraph1,subparagraphs1,3,5,or6ofArticle87,providedthisshallnotapplytooffensesasreferredtoinparagraph2orparagraph3ofArticle91bis.4.Violationsofsubparagraphs7or8ofparagraph1ofArticle87. Article94(deleted) Article95ApersonwhoviolatesanyprovisionofArticle112shallbepunishedbyimprisonmentfornotmorethanoneyear,detention,or,inlieuthereoforinadditionthereto,afineofnotlessthantwentythousandandnotmorethantwohundredandfiftythousandNewTaiwanDollars. Article96AfineofuptofiftythousandNewTaiwanDollarsshallbeimposedforviolationsoftheprovisionsofthesecondparagraphofArticle59ortheprovisionsofArticle64. Article96-1Inanyofthefollowingcircumstancesasentenceofuptooneyearimprisonmentordetentionshallbeimposed,orinlieuthereoforinadditionthereto,afineofnotlessthantwentythousandandnotmorethantwohundredandfiftythousandNewTaiwanDollars:1.ViolationofArticle80bis.2.Violationofparagraph2ofArticle80ter. Article96-2IfafineistobeimposedpursuanttotheprovisionsofthisChapter,thefinancialabilityoftheoffenderandthebenefithe/shehasobtainedthroughcommissionoftheoffenseshallbetakenintoaccount.Ifthebenefitobtainedexceedsthemaximumfine,suchfinemaybeincreasedwithinthelimitoftheobtainedbenefit. Article97(deleted) Article97-1Whenanenterprise,bymeansofpublictransmission,violatestheprovisionsofArticle91,Article92,orArticle93,subparagraph4andisconvictedbyacourt,itshallimmediatelyceasesuchactivities.Iftheenterprisedoesnotceasethoseactivities,thenfollowingtheconveningbythecompetentauthorityofagroupofspecialists,academicians,andrelatedenterpriseswhodeterminethattheenterprise'sactivitiesconstituteaseriousinfringementandthattheymateriallyaffecttherightsandinterestsoftheeconomicrightsholder,thecompetentauthorityshallprescribeaperiodofonemonthwithinwhichtheenterpriseshalltakecorrectiveaction;wheretheenterprisefailstotakecorrectiveactionwithinthatperiod,thecompetentauthoritymayordersuspensionorcompulsoryterminationoftheenterprise'sbusiness. Article98-1Anarticleusedinthecommissionofanoffenseoracquiredthroughthecommissionofanoffensesetforthinparagraph3,Article91,orparagraph3,Article91bis,maybeconfiscatedbythejudiciarypoliceiftheoffenderescapesandisthereforeunidentifiable.Thearticleconfiscatedpursuanttotheprecedingparagraphshallbedestroyed,providedthatwheretheconfiscatedarticleismoney,thatmoneyshallbesubmittedtothenationaltreasury.TherelevantprovisionsoftheActfortheMaintenanceofSocialOrdershallapplymutatismutandistotheproceduresoftheaforementioneddestructionandsubmission. Article106-2ExceptasotherwiseprovidedforinthisChapter,apersonwhobegantheexploitationofworksprotectedpursuanttotheprovisionsoftheprecedingarticlepriortothedateonwhichtheWorldTradeOrganizationAgreementtookeffectintheterritoryunderthejurisdictionoftheRepublicofChina,orwhomadesignificantinvestmenttowardthepurposeofsuchexploitation,maycontinuetoexploitsuchworksduringthetwo-yearperiodwhichcommencesontheaforementionedeffectivedateofsaidAgreement,andtheprovisionsofChapterVIandChapterVIIofthisActshallnotapply.FromtheimplementationoftheJune6,2003amendmenttothisAct,thepersonexploitingaworkpursuanttotheprecedingparagraph,exceptincircumstancesofrentalorlending,shallpaytotheeconomicrightsholderoftheexploitedworkareasonablecompensationfortheexploitationsuchaswouldnormallybepaidforsuchworkthroughfreenegotiation.FromoneyearafterthedateofpromulgationoftheamendmenttothisAct,anexploitershallnotfurthersellunauthorizedcopiesofworksprotectedundertheprecedingarticle;provided,itmaystillrentorlendthem.Theprecedingparagraphdoesnotapplytocopiesofworksthatareseparatelycreatedthroughexploitationofworksprotectedundertheprecedingarticle;providedthat,exceptassetforthinArticles44to65,theeconomicrightsholderoftheexploitedworkshallbepaidareasonablecompensationfortheexploitationsuchaswouldnormallybepaidforsuchworkthroughfreenegotiation. Article106-3ExploitationofaderivativeworkmaycontinuebeyondthedateonwhichtheWorldTradeOrganizationAgreementtookeffectintheterritoryunderthejurisdictionoftheRepublicofChina,wherethepreexistingworkuponwhichsuchderivativeworkisderivedisaworkunderArticle106bis,wherethecompletionofthederivativeworkoccurredpriortotheaforementionedeffectivedate,andwheresuchderivativeworkwasprotectedunderrespectiveversionsofthisact;theprovisionsofChapterVIandChapterVIIofthisActshallnotapply.FromtheimplementationoftheJune6,2003amendmenttothisAct,thepersonexploitingthederivativeworkpursuanttotheprecedingparagraphshallpaytotheeconomicrightsholderoftheunderlyingworkareasonablecompensationsuchaswouldnormallybepaidforsuchworkthroughfreenegotiation.Theprovisionsoftheprecedingtwoparagraphsshallnotaffecttheprotectionofthederivativework. Article111TheprovisionsofArticle11andArticle12shallnotapplyinthefollowingsituations:1.ThecopyrightwasobtainedpursuanttotheprovisionsofArticle10or11ofthisActpriortotheimplementationdateoftheJune10,1992amendmenttothisAct.2.ThecopyrightwasobtainedpursuanttoArticle11or12ofthisActpriortotheJanuary21,1998CopyrightActtakingeffect. Article112WheretheworksofforeignnationalsenjoyedprotectionoftranslationrightspursuanttothisActpriortotheimplementationdateoftheJune10,1992amendmenthereto,translationsofsuchworksmadepriortosaidimplementationdateshallnolongerbereproducedaftersaidimplementationdatewithouttheconsentoftheholderofthecopyrighttosuchworks,unlesssuchexploitationisinconformitywithArticles44throughArticle65ofthisAct.Copiesoftranslationsofworksreferredtointheprecedingparagraphshallnolongerbesoldaftertheexpirationofthetwo-yearperiodfollowingtheimplementationdateoftheJune10,1992amendmenttothisAct. Article113ThisActshallapplytoplaterightsthatwereobtainedpriortotheimplementationdateoftheJune6,2003amendmenttothisAct;provided,thetermofprotectioncalculatedpursuanttothisActhasnotexpired. Article114(deleted) Article115Agreementsforreciprocalcopyrightprotectionsignedbyorganizationsandagenciesofthiscountryandthoseofaforeigncountryshall,uponratificationbytheExecutiveYuan,bedeemed"agreements"asthattermisusedinArticle4. Article115-1Theplaterightsregisterorrecordationlog,andsamplessubmitted,shallbemadeavailabletothepublicforinspectionandcopying.AnycopyrightregisterorrecordationlogthathasbeenregisteredandrecordedpriortotheimplementationdateoftheJanuary21,1998amendmenttothisAct,andanysamplethereofthathasbeensubmitted,maybemadeavailabletothepublicforinspectionandcopying. Article115-2Forthepurposeofhandlingcopyrightlitigation,courtsmayestablishaspecializedcourtorappointspecializedjudges.Thecourtsshalldelivertothespecializedagencyinchargeofcopyrightmattersacopyofdecisionsincopyrightlitigationcases.
